Welcome to Lifoso! Wherever this document says "we", "us", or "our", it is referring to Lifoso. Lifoso runs this store and website, and all of the information, content, features, tools, products, and services that go with them, in order to offer you, the customer, a selected range of products to shop from (the "Services"). Lifoso is built on Shopify, the platform that lets us make the Services available to you.
The terms and conditions below, together with any policies they refer to (these "Terms of Service" or "Terms"), describe your rights and obligations when you use the Services.
Take the time to read these Terms of Service properly. They include important information about your legal rights, among them disclaimers of warranties and limitations of liability.
Whenever you visit, interact with, or use our Services, you are agreeing to these Terms of Service and to our Privacy Policy. If you do not agree to these Terms of Service or to the Privacy Policy, you should not use or access our Services.

Please bear in mind, though, that colours and the general look of a product can appear differently on screen depending on the device you use to view the store and the way that device is set up and configured.
We do not warrant that the appearance or quality of any product or service you buy will meet your expectations or match how it is shown or rendered in our online stores.
We may change product descriptions at any time without notice, at our sole discretion. We may withdraw any product at any time, and we may cap the quantities of any product made available to a given person, geographic region, or jurisdiction, deciding case by case.

SECTION 3 - ORDERS
An order placed with us is an offer to purchase. Lifoso reserves the right, at its discretion, to accept or refuse your order for any reason. No order is accepted until Lifoso has confirmed acceptance. We must receive and process payment before we can accept an order. Check your order carefully before you submit it, because Lifoso may not be able to accommodate cancellation requests once an order has been accepted. If we refuse, change, or cancel an order, we will make reasonable efforts to let you know using the email address, billing address, and/or phone number you supplied when ordering.
Purchases can be returned or exchanged only in accordance with our Refund Policy.
You represent and warrant that you are buying for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions can change without notice. The price you pay for a product or service is the price in force when the order is placed, as stated in your order confirmation email. Unless we clearly say otherwise, the prices shown exclude taxes, shipping, handling, customs, and import charges.
Prices in our online stores may differ from prices offered in physical stores or in online or other stores run by third parties. From time to time we may offer promotions on the Services that affect pricing; those promotions are governed by their own terms and conditions, which are separate from these Terms. If a promotion's terms conflict with these Terms, the promotion's terms apply.
For each purchase you make in our stores, you agree to give us purchase, payment, and account information that is current, complete, and accurate. You agree to update your account and other information promptly, including your email address, credit card numbers, and expiry dates, so that we can complete your transactions and reach you when necessary.
You represent and warrant that (i) the credit card information you give us is true, correct, and complete, (ii) you are properly authorised to use that credit card for the purchase, (iii) your credit card company will honour the charges you incur, and (iv) you will pay the charges you incur at the posted prices, including shipping and handling charges and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping or delivery delays. Every delivery time we quote is an estimate only and is not guaranteed. Delays that stem from shipping carriers, customs processing, or events outside our control are not our responsibility. Title and risk of loss pass to you when we hand the products to the carrier.

SECTION 6 - INTELLECTUAL PROPERTY
Everything that makes up our Services, including without limitation all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, together with their design, selection, and arrangement, is the property of Lifoso, its affiliates, or its licensors and is protected by patent, copyright, and other intellectual property laws in the U.S. and abroad.
These Terms allow you to use the Services only for your personal, non-commercial use. Without our prior written consent, you may not reproduce, distribute, modify, build derivative works on, publicly display, publicly perform, republish, download, store, or transmit any material found on the Services. Other than as expressly set out here, nothing in these Terms grants you, or should be read as granting you, a licence or any other right under any patent, trademark, copyright, or other intellectual property of Lifoso, Shopify, or any third party. Unauthorised use of the Services may breach federal and state intellectual property laws. Lifoso reserves every right not expressly granted here.
Lifoso's names, logos, product and service names, designs, and slogans are trademarks owned by Lifoso or by its affiliates or licensors. They may not be used without the prior written permission of Lifoso. The name, logo, product and service names, designs, and slogans of Shopify are Shopify's trademarks. All other names, logos, product and service names, designs, and slogans that appear on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS
Through the Services you may be able to use customer tools provided by third parties, which we neither monitor nor control and over which we have no input.
You acknowledge and agree that we make such tools available "as is" and "as available," without warranties, representations, or conditions of any kind and without any endorsement. We accept no liability of any sort arising from or connected with your use of optional third-party tools.
Any use you make of the optional tools offered through the site is entirely at your own risk and discretion, and you should make sure you are familiar with, and approve of, the terms on which the relevant third-party provider(s) supply those tools.
We may also introduce new features through the Services in future (including new tools and resources). Any such new features form part of the Services and are also subject to these Terms of Service.

Materials and hyperlinks pointing to websites supplied or operated by third parties (embedded third-party functionality included) may appear within the Services. It is not our job to examine or assess the content or accuracy of third-party materials or websites that you decide to visit. You leave the Services to access such materials or third-party sites at your own risk.
We are not liable for any harm or damage connected with your visit to a third-party website, or with buying or using any products, services, resources, or content on a third-party website. If you have a complaint, claim, concern, or question about a third party's products or services, take it up with that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Shopify is the platform on which Lifoso is built and enables us to provide the Services to you. Even so, every sale or purchase made in our Store is made directly between you and Lifoso. By using the Services, you acknowledge and agree that Shopify has no responsibility for any aspect of a sale between you and Lifoso, including any injury, damage, or loss resulting from the products and services you buy. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising out of or connected with your purchases and transactions with Lifoso.

SECTION 10 - PRIVACY POLICY
Personal information collected through the Services is subject to our Privacy Policy, which you can read here, and some personal information may also be subject to Shopify's Privacy Policy, available here. Using the Services confirms that you have read both of these privacy policies.
Because Shopify hosts the Services, Shopify collects and processes personal information about your access to and use of the Services so that it can provide and improve them for you. Information submitted to the Services is passed to and shared with Shopify, and with third parties that may be based in countries other than yours, so that services can be provided to you. We may, but are not obliged to, monitor, edit, or remove Feedback that in our sole discretion we consider unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, or otherwise objectionable, or that infringes anyone's intellectual property or these Terms of Service.
You agree that your Feedback will not breach anyone's rights, including rights of copyright, trademark, privacy, personality, or any other personal or proprietary right. You further agree that your Feedback will not contain libellous or otherwise unlawful, abusive, or obscene material, nor any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone you are not, or otherwise mislead us or third parties about the origin of any Feedback. Responsibility for any Feedback you submit, and for its accuracy, rests with you alone. Feedback posted by you or by any third party is not our responsibility, and we accept no liability for it.

You further agree not to: (a) upload or send viruses or any other malicious code that is, or could be, used in a way that interferes with how the Services function or operate; (b) copy, duplicate, reproduce, extract, sell, resell, or otherwise exploit any portion of the Services; (c) gather or track other people's personal information; (d) use the Services for spamming, phishing, pharming, or pretexting; (e) access the Services by means of any robot, spider, scraping tool, data gathering and extraction tool, automatic device or process, AI tool (agentic AI included), or other automated or manual method; or (f) interfere with, bypass, or circumvent the security or authorisation features, robot exclusion headers, or other measures we use to limit access to the Services. If we decide that you have breached any part of these Terms, we reserve the right to suspend, disable, or terminate your account at any time without notice.

SECTION 14 - TERMINATION
We may, at our sole discretion, end this agreement or your access to the Services (or any part of them) at any time without notice, and you remain liable for all amounts due up to and including the date of termination.
The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, and Privacy Policy, as well as any other provision that by its nature ought to outlast termination.

SECTION 15 - DISCLAIMER OF WARRANTIES
Information presented on or through the Services is made available purely for general information purposes. We give no warranty as to its accuracy, completeness, or usefulness. Any reliance you place on that information is strictly at your own risk. We accept no liability or responsibility for reliance placed on such materials, whether by you, by another visitor to the Services, or by anyone who may be told what they contain.
EXCEPT AS EXPRESSLY STATED BY Lifoso, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

SECTION 16 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL Lifoso, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Lifoso, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, owed to any third party as a result of or arising from (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or of the rights of a third party, or (3) your access to and use of the Services.
We will let you know about any indemnifiable claim, although failing to notify you promptly will not release you from your obligations unless you are materially prejudiced as a result. We may assume control of the defence and settlement of such a claim at your expense, including choosing counsel, but we will not settle any claim that places non-monetary obligations on you without your consent (which may not be unreasonably withheld). You agree to cooperate in defending indemnified claims, including by supplying relevant documents.

SECTION 18 - SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision will still be enforced to the fullest extent allowed by applicable law, and the unenforceable part will be treated as severed from these Terms of Service. The remaining provisions stay valid and enforceable regardless of that finding.

SECTION 19 - WAIVER; ENTIRE AGREEMENT
Should we not exercise or enforce a right or provision of these Terms of Service, we have not thereby waived that right or provision.
These Terms of Service, together with any policies or operating rules we publish on this site or in relation to the Service, make up the entire agreement and understanding between you and us and govern your use of the Service, replacing any earlier or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, without limitation, any earlier versions of the Terms of Service).
Where these Terms of Service are ambiguous, the ambiguity is not to be interpreted against the party who drafted them.

This Agreement, and your rights and obligations under these Terms, cannot be delegated, transferred, or assigned by you unless we have consented in writing beforehand; any attempt to do so has no effect. These Terms of Service, and any separate agreement under which we provide Services to you, are governed by and interpreted in accordance with the laws applied by the federal and state or territorial courts of the jurisdiction where Lifoso is headquartered. You and Lifoso agree to venue and personal jurisdiction in those courts.

Headings in this agreement exist purely for ease of reference; they neither limit nor otherwise affect these Terms.

You can review the latest version of the Terms of Service on this page at any time.
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by publishing updates and changes on our website. It is up to you to check our website periodically for changes. We will notify you of any material changes to these Terms as required by applicable law, and those changes take effect on the date given in the notice. If you keep using or accessing the Services after changes to these Terms of Service have been posted, you accept those changes.
